This Privacy Policy describes how Pique (“Pique,” “we,” “us,” or “our”) collects, uses, stores, and shares your information when (1) you access and/or use our websites, mobile applications, or other digital properties we own and operate, including www.piquecollects.com (“Websites”); (2) you use our collection management platform and related services (“Platform”); (3) you communicate with us in any manner, including by email, direct messaging, telephone, and/or in person (“Communications”); and (4) we interact with certain third party partners.

Please be advised that the practices described in this Privacy Policy apply only to information gathered by us when you use our Platform. It does not apply to any information you provide to third-party platforms and services used in conjunction with our Platform, such as payment processors or other third-party services.


Introduction

At Pique, we are building a private-by-default platform for serious fashion collectors to catalog, organize, and enjoy their collections. Our mission is to help collectors preserve and manage their fashion assets while maintaining their privacy.

Through our mobile application and web platform, users can catalog their collections, store purchase documentation and service history, manage item provenance and more as we continue to build. In order to provide these services, we must collect certain information from you and from third parties.

What Type Of Information Do We Collect?

Depending on how you interact with our Websites and Platform, the nature of our Communications, and how we may interact with certain third-party partners, we may collect the following pieces of your information:

  • Basic Identifying Information. Information you provide when you sign up for an account, such as your full name, e-mail address, phone number (when provided), account name, username, and other similar identifiers.
  • Device Identifiers and Other Unique Identifiers. Information such as your device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, and other unique identifiers.
  • Internet or Other Network Activity. Information such as your browsing or search history, and other information regarding your interactions with our Websites, Platform, emails, and advertisements.
  • Payment Information. Information such as your credit card number, debit card number, billing address, payment method details, transaction history, and any other information necessary to process subscription payments or service fees, or to prevent fraudulent transactions. We utilize third-party payment processors, including Stripe and Apple (for in-app purchases), to process payment information. These processors collect payment information directly from you on our behalf. For more information about payment processors, see Payment Processors below.
  • Geolocation Data. If you enable location services, information that permits us to determine your general or precise location. We may use this to provide location-relevant features or services.
  • Collection and Item Data. Information about your fashion collection, including photographs of items (both original images and AI-processed versions, such as background-removed images), item metadata (designer, category, notes, year, purchase price, provenance, and condition), purchase receipts and invoices, service and authentication records, wear history, and packing lists. This data forms the core of your collection catalog and may include financially sensitive information.
  • User Content. Information such as your Communications with us, notes and descriptions you add to your collection items, and any other content you provide, such as survey responses, comments, and feedback.
  • Inferences. Information such as inferences drawn from or created based on the information identified above.

How Do We Collect Your Information?

We collect your information in three ways: (1) directly from you when you use our Websites, Platform, and Communicate with us; (2) automatically using online technologies when you engage with our Websites, Platform, and Communications; and (3) from our third-party partners.

  • Directly From You. We collect information directly from you when you create an account for our Platform, update your profile, upload photographs and documentation for your collection items, add metadata and notes, participate in services we offer, engage in Communications with us, or sign up to receive emails or other Communications from us.
  • Automatically Using Online Technologies. When you visit our Websites, open or click on emails we send you or related Communications, or interact with our advertisements, we or other third parties may automatically collect certain information about you using online tracking technologies such as cookies, pixels, web beacons, software developer kits, and related technologies.   • From Third Party Sources. We collect information from our third-party partners, such as payment processors, data analytics providers, and service providers who provide us with business functions.

Cookies and Related Online Tracking Technologies

A. Tracking Technologies Used

  • Cookies. Cookies are pieces of information stored on the computer or mobile device that you are using. Cookies allow us to collect information such as browser type, time spent on the Site, pages visited, registrations, submissions, demographics, information requests, language preferences, and other traffic data. With respect to how long a cookie stays on your computer or mobile device, some cookies are session cookies that expire once you close your browser while others are persistent cookies which stay on your device until you delete them, or they expire.
  • Pixels. Pixels (also known as web beacons) are types of code embedded in a website, video, email, or advertisement that send information about your use to a server. When you access a website, video, email, or advertisement that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser.
  • Software Development Kits. Software Development Kits (SDKs) are sets of tools and code provided by third parties that are embedded in our software to enable specific functionalities and improve user experience. Some SDKs may collect data directly from your device, such as your IP address, device type, or usage patterns, to support these functions.
  • Analytic Tools. We use third-party analytics providers such as Google Analytics on the Sites. Google Analytics uses cookies and similar technologies and IP addresses to collect and analyze information about use of the Platform and report on activities and trends. Google Analytics may also collect information regarding the use of other websites, apps, and online resources. B. Why Do We Use Tracking Technologies?

  • Functionality, Support and Security. Some of the online tracking technologies like the cookies we use are to recognize your device, to facilitate navigation, to display information more effectively, to personalize your experience, maintain the security of our Sites, manage your account, prevent crashes, fix bugs, save your preferences, and assist with basic Site functions and other performance functions.
  • Advertising and Marketing Measurements. Pixel tags may be used to market our services and other products we think are relevant to you, measure the success of our marketing campaigns and compile statistics about Website and Platform usage and response rates. Furthermore, we may incorporate pixels from separate entities that allow us to bring you advertising both on and off the Website.
  • Behavioral Analytics. We also use pixels in combination with cookies to track activity by a particular browser on a particular device. These pixels are provided by a third party and certain information may be shared back with such provider. In addition, we may use technologies included in applications (that are not browser-based like cookies and cannot be controlled by browser settings), such as SDKs, to track our communications, bring you advertising, and provide you with additional functionality, such as the ability to connect your account on our Sites with other third-party services.   • Site Analytics. We use analytics services, such as Google Analytics, to help us understand how users access and use the Sites through the use and sharing of cookies. You can learn about Google’s practices by going to www.google.com/policies/privacy/partners/.

Payment Processors

We use third-party payment processors to process payments on our behalf. When you make a payment through the Platform—including subscription fees or service fees—your payment information (such as credit card number, billing address, and other financial data) is collected and processed directly by these third-party providers. We do not store or have access to your complete payment card information. These payment processors are contractually required to protect your Personal Information and to use it only for purposes of processing transactions on our behalf and complying with legal obligations.

How Do We Use Your Information?

We use your information for a variety of purposes, including to:

  • Provide our Platform to You. We use your information to provide our Platform to you, including to: (1) create and manage your account when you sign up; (2) facilitate your access to and use of collection management features; (3) process and store your collection data, photographs, and documentation; (4) provide AI-enhanced image processing for your item photographs; (5) enable you to create and export packing lists; (6) send you notifications relating to your account and activity; (7) answer your Communications; and (8) perform other related business functions.
  • Communicate with You. We use your information to engage in Communications with you, such as to respond to your requests, inquiries, issues, feedback, and to provide customer service.
  • Provide Archiving Services. If you use our archiving services, we use your information to catalog and photograph your collection items, record provenance and condition, and provide related documentation that may be relevant for insurance or authentication purposes.
  • Provide Services to Institutional Customers. Where galleries, estates, museums, or other institutional customers use our Platform to manage their collections, we process related information in order to provide services to such institutional customers.
  • Market and Advertise. We use your information for marketing and advertising purposes, including sending marketing, advertising, and promotional communications to you by email. We may also use your information to show you advertisements for our Platform and services.
  • Conduct Analytics and Product Improvement. We use your information to conduct research and analytics, including to improve our Platform and develop new features. We may use aggregated, anonymized data derived from user collections to understand market trends, such as which designers, categories, or eras are popular among collectors. This trend data is anonymized and does not include any personally identifying information.
  • Security and Fraud Prevention. We use your information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions. We also use your information to enforce our terms and procedures, prevent security incidents, and prevent harm to other users of our Platform.
  • Legal Obligations. We use your information to comply with our legal and regulatory obligations, to establish and exercise our rights, and to defend against legal claims.
  • Business Functions. We use your information to support our core business functions, including to maintain records related to business management, loss prevention, collecting amounts owed, and identifying and repairing errors or problems in the Websites.

How Do We Disclose Your Information?

We may disclose or share your information with affiliated and non-affiliated third parties, including in the following scenarios:

  • With your Consent. We may disclose or share your information with your consent, which may be obtained in writing; online, through “click-through” agreements; when you accept the terms of use on our Websites; orally, either in person or on the phone; or by other means.
  • In a Business Transfer. We may disclose or share your information as part of a corporate business transaction, such as a merger or acquisition, joint venture, corporate reorganization, financing, or sale of company assets, or in the unlikely event of insolvency, bankruptcy, or receivership, in which such information could be transferred to third parties as a business asset in the transaction.
  • Institutional Customers. If you use our Platform in connection with an institutional customer (such as a gallery, estate, or museum), we may share information with that institutional customer as necessary to provide the services.
  • To Non-Affiliated Third Parties. We may disclose or share your information with certain non-affiliated third parties to facilitate your access and use of our Platform, and to provide us with certain business functions, including but not limited to sharing your information with internet service providers, cloud storage providers, data analytics providers, payment processors, and service providers who provide us a service (e.g., customer service, AI image processing, debugging, and/or protecting against malicious, deceptive, fraudulent, or illegal activity).
  • For Legal Process And Protection. We may disclose or share your information to satisfy any law, regulation, legal process, governmental request, or where we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to: (1) enforce or apply our agreements; (2) protect our interests, property, or safety of others; (3) in connection with claims, disputes, or litigation; and (4) to protect our Websites.

How Do We Protect Your Information?

Although no system can guarantee the complete security of your information, we take commercially reasonable steps to ensure your information is protected in alignment with all applicable laws and regulations, as appropriate to the sensitivity of your information. Given the nature of the data stored on our Platform—including photographs, purchase records, provenance documentation, and other collection data—we implement appropriate technical and organizational measures to protect this information.

How Long Do We Keep Your Information?

We keep your information for as long as is necessary in accordance with the purpose for which it was collected, our business needs, and our legal and regulatory obligations. For collection data (including photographs, item metadata, receipts, and provenance records), we retain this information for as long as your account is active or as needed to provide you with our services. If we dispose of your information, we will do so in a way that is secure and appropriate to the nature of the information subject to disposal.

Account Deletion. You may request deletion of your account and associated data at any time using the “Delete My Account” feature within the Platform or by contacting us. Upon receiving a valid deletion request, we will delete your personal information and collection data within a reasonable timeframe, except to the extent we are required to retain certain information for legal, regulatory, or legitimate business purposes (such as fraud prevention or dispute resolution). Please note that once your account is deleted, your collection data cannot be recovered.

Sub-Accounts and Delegated Access

Our Platform may allow you to grant limited access to your account to other individuals, such as stylists, assistants, or other delegates (“Sub-Account Users”). Each Sub-Account User must have a unique email address. When you grant access to a Sub-Account User, that individual will be able to access certain information in your collection based on the permissions you set. You are responsible for managing Sub-Account User access and permissions. Information about Sub-Account Users’ access and activities may be visible to the primary account holder.

Links To Third Party Sites

Our Websites and Platform may contain links to third party websites and services. Please note that these links are provided for your convenience and information, and the websites and services may operate independently from us and have their own privacy policies or notices, which we strongly suggest you review.

Your Choices

For all individuals, regardless of location, you have the following rights:

  • Account Information. You may access, update, or remove certain information that you have provided to us by sending an email to the email address set out in the “Contact Us” section below. We may require additional information from you to allow us to confirm your identity. Please note that we will retain and use information about you as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
  • You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail you receive from us. You can also manage your communication preferences by contacting us at the email address set out in the “Contact Us” section below.

Tracking Technology Choices.

  • Cookies and Pixels. Most browsers accept cookies by default. You can instruct your browser, by changing its settings, to decline or delete cookies. If you use multiple browsers on your device, you will need to instruct each browser separately. Your ability to limit cookies is subject to your browser settings and limitations. Below are links to instructions for managing cookies on commonly used browsers:
  • Push Notifications. If you have enabled push notifications on your mobile device, you may receive updates, alerts, or other communications from us via these notifications. You can control your preferences for push notifications at any time by adjusting the settings on your device or within the relevant application. Please note that disabling push notifications may affect your ability to receive timely updates or important information related to our services.
  • Do Not Track. Our Websites may, from time to time, collect information about your online activities, over time and across our different websites. When you use our Websites, third parties may also collect information about your online activities, over time and across different internet websites, online or cloud computing services, online applications, or mobile applications. Some browsers support a “Do Not Track” feature, which is intended to be a signal to websites that you do not wish to be tracked across different websites you visit. Our Websites do not currently change the way they operate based upon detection of a “Do Not Track” or similar signal.

Children

Our Platform is not intended for children under the age of 13. We don’t knowingly collect the information of children under 13 for any reason. If you believe we have inadvertently collected information from a child, please contact us, and we will promptly delete it accordingly.

We may change this Policy from time to time. Any and all changes will be reflected on this page, and where appropriate provided in person or by another electronic method. A. Role and Data Controller Contact Details

The General Data Protection Regulation (“GDPR”) and data protection laws in Europe distinguish between organizations that process personal information for their own purposes (known as “controllers”) and organizations that process personal information on behalf of other organizations (known as “processors”).

We act as a controller with respect to personal information collected from you as you engage with our Websites, Platform, or via Communications with us. In limited situations where we process specific information on behalf of institutional customers (such as galleries, estates, or museums), we may act as a processor.

B. Lawful Basis for Processing

The GDPR and data protection laws in Europe require a “lawful basis” for processing personal information. Our lawful bases include the following:

  • To fulfill obligations in the agreement between you and Pique. To use our Platform, you and Pique entered into an agreement under the applicable terms of use, and in order for us to fulfill our obligations with respect to providing our Platform under such agreement, we must collect your personal information to provide the necessary functionality. The information we collect and how it is used by us is further detailed in the sections entitled What Type of Information Do We Collect? and How We Use Your Information? above.
  • To pursue our legitimate interests. Our legitimate interests include, among others, understanding how our Websites or Services are functioning, improving our Websites or Services, developing new products and services, and preventing fraud. To pursue the foregoing, we process personal information. Where we rely on a legitimate interest to process personal information, we carry out a balancing test to weigh the legitimate interest against your right to protection of your personal information; however, our processing of your personal information will never override your fundamental rights and freedoms, and you can always exercise your right to object to such processing.
  • Consent. In certain situations where you provide us with consent, we may process your personal information.
  • To comply with law. In limited circumstances, we may process personal information in order to comply with legal obligations. C. Onward Transfer

If you choose to provide us with your information, you consent to the transfer and storage of that information on our servers located in the United States.
